this policy (“Policy”) in accordance with article n. 13 d. lgs. 196/2003 (concerning the protection of personal data – “Codice”), disciplines the treatment of personal data that you might communicate to Uncle s.r.l. (“Uncle”) owner of the Restaurant Ubarba, including without limitation, by using the services provided by our Website (“Website”).

This Policy disciplines the practices used by Uncle to collect, use, protect, disclose or process in any other way, personal data collected from the Website users  (“User”).

With “Personal data” we mean any kind of information that identifies you as an individual, identified or identifiable, also non-directly, by reference to any other information (art. 4, lett. b, Codice). When you communicate sensitive information to Uncle (art. 4, lett. d, Codice), as food allergies or intolerances (“Sensitive information”), they will be processed in accordance with the Autorizzazioni Generali del Garante per la Protezione dei Dati Personali n. 2/2014 and n. 5/2014, strictly for the period of time necessary to achieve the requested service, and in compliance with this Policy.

Uncle may revise, integrate or update this Policy at any time, considering eventual modifications of the applicable legislation, emendments requested by the Garante per la Protezione dei Dati Personali, or services provided by the Website. Eventual modifications and updates will be published on the Website, therefore you should check the Website regularly to review the current Policy.

Personal Data and Sensitive Information collection

Uncle may collect Personal Data from the Users in a variety of ways, specifically:

• Directly from the User: these are all the Personal Data you provide directly by using our Website (browse from page to page, register, or in any other way), or by communicating them during events organized by Uncle. Informations about your position, sent to Uncle through the geolocalization serivce on our Website, are included.
• Automatically collected: Personal Data collected automatically through, but not only, “cookies”, are data about your internet browsing. Computer systems and software procedures that allow the Website to work may collect, as effect of their ordinary operations, some Personal Data, whose transmission is related to the standard usage of internet protocols. These informations are not collected to recognise a specific person, but could be leading to a specific User by associating the identification numbers in the cookies with other customer informations. In this category of Personal Data are included IP addresses and domain names of the PCs used to browse the Website, URI (uniform resource identifier) of the requested resources, time and method of request, dimension of the response file, numerical code of the server’s response and other parameters concerning the OS and the informatic environment of the User. This kind of Personal Data are mainly used to elaborate statistics about the Website usage and to check it is working correctly. Uncle may only collect and use Sensitive Information uniquely when the User communicates them in whatever manner.

Uncle is fully aware of the importance of Personal Data processing. Therefore, without the specific consent of the User, Uncle will not collect any information, nor will use any technology that could lead to identify single Users of the Website.

Place, modalities and disclosure of your information

Use of information is generally located by Uncle’s head office. Personal Data and eventual Sensitive Information might be accessed uniquely by our staff.

Personal Data and Sensitive Information are processed by Uncle and third parties, selected by Uncle that may undertake various activities such as providing support services for us such as delivering alimentary products to the Customer. In any other case, unless your express consent, Personal Data and Sensitive Information will not be divulgated to third parties. A complete list of our partners that can obtain such kind of Personal Data is available at Uncle’s head office.

Personal Data are processed and stored, in accordance with the obligations and warranties provided for in the Codice, both analogically and digitally, by our staff (employees or third parties), strictly for the time necessary to achieve the purposes they are collected for. Sensitive Information are processed and stored, in accordance with the obligations and warranties provided for in the Codice, in the present Policy and in the Autorizzazioni Generali del Garante n. 2/2014 and 5/2014, strictly for the time necessary to achieve the requested service. Uncle takes steps to protect your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage. Uncle will keep your Personal Data and Sensitive Information for a reasonable period (as stated in this policy) or as long as the law requires, unless you give your consent to store them for a longer period or for different puroposes.

Purposes of the utilization and nature of the consent

Uncle will process Personal Data exclusively for the following purposes:

• Purposes related to the utilization of the services provided by Uncle; delivery services and table booking services. Uncle needs Personal Data also to process correctly transactions with the User i.e. managing the account registration process on the website as well as collection of application submitted by the Users. The utilization of geolocalization service is included in these purposes.
• Sensitive Information will be used uniquely in order to protect the health of the User, when delivering alimentary products at home or by the restaurant Uncle owns. That is why it is necessary that the User communicates to Uncle eventual food allergies or intolerances as well as dietary requirements.
• Statistical puroposes, eventually to send the User information and advertisement, newsletters, services that may be of interest and promotional campaigns.

The User’s consent to the utilization of data is mandatory for points I) and II) (whether necessary) to use the services Uncle provides. The consent to point III) is optional, an eventual denial will implicate that the user will not recieve promotional campaigns and notifications nor offers of any nature. When filling in the Personal Data form, the User will be given the opportunity to choose whether consent or not to the utliziation of data for the puroposes stated in point III).

Communication

Every kind of communication or material, including data, questions, comments, suggestions or other, the User voluntarily transmits to Uncle, via e-mail or in any other way will be considered as non-confidential information, unless otherwise stated or unless the confidentiality of data is self-evident in view of the nature of it. In accordance with the applicable standard, every kind of communication submitted will be considered property of Uncle, and could be used for various purposes, included but not limited to divulgation, trasmission, publication and disclosure.

User’s Rights

In accordance with the art. 7 of Codice, every User is in right to request information about the storage and protection of Sensitive Informations regarding him, and their communication. Every User has the specific right to know:

• The source of Personal Data and Sensitive Information
• The purposes and procedures of data processing
• Procedures used by electronic and informatic systems for data processing
• The identification details of the owner, of the managers (or of the person in charge designated in accordance with art. 5, paragraph 2, of Codice)
• Who is/ are the person/s allowed to access the Personal Data, as person/s designated by Uncle

Furthermore, every User has the right to obtain:

• The update, the adjustment or the integration of such data
• The cancellation, the anonymous transformation or the suspension of data processed infringing the law, including data not permanently stored, in accordance with the puroposes such data were collected.
• The notification that the operations stated at points I) and II) have been brought to the attention of the persons such data were communicated to or disclosed, unless such fulfillment is impossible to achieve or reasonably beyond Uncle’s possibilities

The User has the right to object, wholly or partially:

• The Personal Data and Sensitive Information processing, albeit in accordance with the purpose such data were collected
• The Personal Data processing for commercial or marketing purposes, such as market surveys or promotional material communication
